Section 339. Commitment of person to whom pardon has been tendered

Where a pardon has been tendered under section 337 or section 3, and [9] any person who has accepted such tender has, either by wilfully concealing anything essential or by giving false evidence, not complied with the condition on which the tender was made [10] tried for the offence in respect of which the pardon was so tendered, or for any other offence of which he appears to have been guilty in connection with the same matter:

  1. The statement made by a person who has accepted a tender of pardon may be given in evidence against him [11].
  2. No prosecution for the offence of giving false evidence in respect of such statement shall be entertained without the sanction of the High Court. [1] [2] [4] [5] [6] [7]
